Shipping Policy

Order Processing & Fulfillment

Processing Time

Orders are typically processed within 1-2 business days (Mon-Fri, excluding holidays). This period is separate from shipping transit time.

Order Verification

We reserve the right to hold and/or cancel any order flagged as potentially fraudulent. Additional verification may be required, which can delay processing.

Shipping Methods

Delivery estimates provided by carriers are not guaranteed by CellSpark. We are not liable for carrier-caused delays.

Signature Requirements

Orders over $200 require a direct signature. It is the Purchaser's sole responsibility to be available. Waiving a signature releases CellSpark from all liability for loss or theft.

Order Cancellation

Due to immediate fulfillment, orders are final upon payment and cannot be canceled or altered. Please review your order carefully before purchase.

Shipping Fees

All shipping and handling fees are non-refundable under any circumstances, including but not limited to carrier delays or refused packages.

Shipment, Title, and Risk of Loss

FOB Shipping Point

All shipments are made FOB (Freight on Board) Shipping Point. Title and all risk of loss or damage transfer to the Purchaser the moment the package is tendered to the carrier.

Address Accuracy

The Purchaser is solely responsible for providing a correct, complete, and secure shipping address. We are not liable for any loss resulting from incorrect address details.

Permitted Addresses

We ship to most valid US addresses, including P.O. Boxes. We do not ship to mail forwarding services or APO/FPO/DPO addresses.

Refused Packages

Packages refused by the recipient or returned as undeliverable will be considered abandoned by the Purchaser. No refund, credit, or reshipment will be provided.

Shipment Tracking

The Purchaser is responsible for monitoring tracking information. CellSpark is not responsible for notifying customers of delivery status, exceptions, or delays.

Delivery Issues & Claims Protocol

Purchaser's Responsibility

The Purchaser's sole recourse for any shipping issue is with the shipping carrier. CellSpark's liability ceases upon tender to the carrier.

Lost in Transit

A package is not considered lost until 10 business days have passed with no tracking updates. After this period, the Purchaser must initiate a formal trace and claim process directly with the carrier.

Theft & Non-Delivery

CellSpark is not liable for packages stolen after a confirmed delivery. We will not investigate non-delivery claims until the Purchaser provides a verifiable police report and proof of a claim filed with the carrier.

Carrier Delays

We do not guarantee delivery dates. We are not liable for carrier delays, and no refunds for shipping costs will be issued due to such delays.

Fraud, Chargebacks & Remedies

Fraudulent Claims

Any false claim constitutes fraud. We reserve the right to report such activity to law enforcement and pursue all available legal and civil remedies.

Improper Chargebacks

Initiating a chargeback without following our claim process is a breach of this policy. We will use this agreement and all order data to dispute it.

Chargeback Liability

If a chargeback is decided in our favor, you are liable for the original amount plus bank fees, a $50 administrative fee, and all collection costs.

Right to Refuse Service

We reserve the right to refuse service and permanently ban any individual or entity engaging in fraudulent activity or improper chargebacks.

Purchaser's Covenants & Legal Agreement

Purchaser Qualification

Purchaser warrants they are a qualified researcher or institution, over 21, and not prohibited by any law from receiving our products.

International Shipments

The Purchaser is the importer of record, responsible for all customs, duties, and import regulations. We are not liable for customs seizure.

Limitation of Liability

In no event shall CellSpark be liable for any indirect, punitive, incidental, special, or consequential damages arising from the shipping or delivery of products.

Force Majeure

We are not liable for shipping failures caused by events beyond our control, including acts of God, natural disasters, war, pandemics, or carrier failures.

Indemnification

Purchaser agrees to indemnify, defend, and hold harmless CellSpark from any claims, liabilities, damages, and legal fees arising from shipping disputes.

Governing Law & Venue

This policy is governed by the laws of the State of Nevada. Any dispute shall be resolved through final and binding arbitration in Clark County, NV.

Policy Acceptance

By completing a purchase, the Purchaser affirms they have read, understood, and agree to be legally bound by all terms and conditions contained herein.

Entire Agreement

This document, along with our Terms of Service and Refund Policy, constitutes the entire agreement between the Purchaser and CellSpark.
